For valuable consideration, the receipt and adequacy of which are hereby acknowledged, I do hereby grant the Association of Family and Conciliation Courts, California Chapter (“AFCC-CA”):
A. The exclusive, worldwide, perpetual, and royalty-free rights:
1) To audio record, videotape, and/or digitally record my presentation to be given at the AFCC-CA Annual Conference, February 5th through 7th, 2027, at the Anaheim Marriott, 700 W Convention Way, Anaheim, CA 92802, United States.
2) To print, reprint, publish, reproduce, use, publicly perform, broadcast, modify, create derivative works from, distribute, and sell the audio/video/digital materials (“Audio/Video/Digital Materials”) in their entirety or in any portion, individually or in conjunction with other works, in audio, video, electronic, or digital form, including but not limited to the exercise of such rights through Internet or Intranet sites, computer on-line services, and all other electronic media and distribution mechanisms now known or later developed, whether or not compensation is received, provided that any formatting modifications or derivative works do not substantively change the content of my presentation.
B. With regard to the written materials prepared in connection with my presentation (“Written Materials”), the non-exclusive, worldwide, perpetual, and royalty-free rights to print, reprint, publish, reproduce, use, modify, create derivative works from, distribute, and sell the Written Materials in their entirety or in any portion, individually or as a collective work, in print, electronic, or digital form, including but not limited to the exercise of such rights through, Internet or Intranet sites, computer on-line services, and all other electronic media and distribution mechanisms now known or later developed. Any materials included that the presenter herein is not the author of must have a separate and individual release from that author or authors. The author/presenter herein may use his or her written materials and slides in other programs and formats.
C. The right to use my name, voice, photograph, and likeness in connection with the exercise of the rights granted in Sections A and B.
D. The right to use the DVD’s, CD’s, MP3’s and other formats created for this program in continuing education programs, to sell the DVD’s, CD’s, MP3’s and other formats on its website, or distribute them to Family Law professionals, such as Family Law judicial officers, for educational purposes.
I hereby release and discharge AFCC-CA, including without limitation to its directors, officers, employees, agents, and representatives, from any and all claims, demands, and causes of action that I may have against it by use of the Audio/Video/Digital or the Written Materials, including without limitation any claims based on the right of privacy, the right of publicity, copyright, libel, or slander. With the exception of the materials that are in the public domain, and acknowledging that simply because materials are publicly available or the internet does not place these materials in the public domain, I warrant that I am either the sole owner of all rights in the Audio/Video/Digital Materials and the Written and Presentation Materials, and portions thereof, that I have provided, or I warrant that I have obtained written permission from the author or authors to use them.
I also warrant that, to the best of my knowledge, the Audio/Video/Digital Materials, the Written Materials and the Presentation Materials do not infringe the copyright or other property rights of any third party, and that I have full power to convey the rights granted in this Agreement, or I have obtained written consent to do so.
